Jug's take...

JoePa fired last night…probably was a good idea for them to announce it at night when college students are up and drinking. This post will be pretty much all about the PSU stuff. We are all very opinionated about it, however, if you haven’t read the indictment, I highly encourage you to do so. Obviously those protesting last night did not.

I’ll start with McQueery. He should be fired too. I have more of an issue with him doing nothing at all to stop the act while it was taking place. I understand being in shock because that is something you just never expect to see. I also understand the instinct to protect people, especially people who can’t protect themselves like that ten year old boy. At a minimum McQueery should have called the police right then and there. If he was going to close the door to the shower, it should have been to get a baseball bat or something. McQueery’s father issued a statement saying that his son “is a good and strong kid, and did what he was supposed to do”. No he didn’t. He absolutely did not. I am quite certain that if McQueery was the ten year old boy, then his father would not find those actions acceptable. They say it takes a village to raise a kid. We all have a responsibility to watch out for kids, maybe not in a legal sense, but as human beings.

JoePa…JoePa is the biggest name in this whole thing, so naturally he will get the most attention, and rightfully so. It’s his show. That doesn’t mean he is getting most of the blame. Remember, the guy who did it is in jail and will be for a long time. I can understand how tough it would be to hear that someone you’ve known for years is fondling young kids in the shower. You don’t want to believe that. However, if McQueery was as distraught as he says he was, wouldn’t you think there might be some validity to what he was saying that would require more than a phone call to your boss? At least follow up? I do understand he did only what he was legally required to do. I feel that Kod was expressing that last night, but I also think that Kod feels he should have done more too... Not sure that came across. Sometimes laws protect the guilty, not the innocent. I absolutely believe that JoePa is sincere when he says he wishes he would have done more. It’s sad that he didn’t. However, how often is the truth actually better than what was initially reported? Right now they are still sifting through the cover-up. It’s going to get worse.

A small, sad side note is how is career is coming to an end. I know he did a lot of good for kids and the community over the course of his career and that stuff hasn’t changed. The terrible part in this is the trauma those kids endured because so many people failed them, and the emotional problems they will have for the rest of their lives because of it. A guy called into Cowherd yesterday who had been abused as a kid and talked about the lasting effects. It was a powerful phone call, the guy was almost in tears at points. I don’t get too caught up in a lot of stories in the media, but this one makes me angry.

On a lighter note…4 day weekend for me. I have a double header softball game tonight followed by NFL football at somewhere that serves wings. Tomorrow morning I’m going to my mom’s school with my brother (he is in the Naval reserves) for a Veteran’s Day event they have there every year. After that, free lunch at Hooters. Saturday I am going to a turkey fry. Fmjug’s dad and a bunch of his friends and family (all guys) get together at this time of year and fry turkey’s for the holidays and hangout and drink. Good people and good times. Sunday the family is coming over for the Bears Lions game (bet Mize?).

Pretty interesting discussion yesterday on LOV about the UPenn mess. I'm not as dramatic about it as H (imagine that) but I was also surprised by kod's take on it all.

With all due respect kod, that's been my experience with attorneys though - often they get so caught up with what is technically legal or not legal that they lose sight of the real world considerations outside of that.

If you had a son though kod and after JoPa did his "legal duty" your son became a subsequent victim, I wonder if you'd still think JoPa did enough.

Minor correction, Jug. Sandusky is out on bail, but i agree with your overall point. He has already been charged and a jail term is basically a foregone conclusion, so the anger turns now to others who were enablers.

I am only going by what the national news sources are reporting, but my understanding is that he had a contractual duty to go to the AD (through his policies/contract), which he did, and that the policies were silent on going to the police (they could not legally say someone can't go to the police to report a crime in their policies...and since it's Penn State University, I'm certain an employment law expert drafted the policies). Since PA laws do not make Joe Pa a mandatory reporter, there was no legal or contractual duty. (ethical duty-perhaps)

Penn State could have made Joe Pa a mandatory reporter through their policies, but they didn't.

This is why I am so outraged at Penn State, both for being complicit in the horrible acts of abuse, and also for making Joe Pa out to be a scapegoat after everything he did for them....and for what, following their policies and breaking no laws?

My non-perp outrage is directed at the higher ups at the University (AD and/or president depending on how things went after JP told the AD)

I'm not sure that you understand exactly what "my" professional moral code is. As an attorney, I am the opposite of a mandated reporter most of the time....my professional moral code is mostly about privileges, confidentiality, and secrecy; most things I cannot report, even if ethically I would want to (if I wanted to keep my law license that is).

Attorneys are not social workers, teachers, clergy, etc. Even legal aid attorneys like myself are still attorneys and bound by the same codes and regulations. Where other people have to report, I could lose my license if I do report.

Kod, my point about your code of ethics was not that you would report it. I know you can't divulge provledged information as an attorney. My only point is that being as how you are legally bound NOT to say something, you would be more outraged by someone who is not bound from saying something to the authorities simply choosing not to. Especially an educator (which he is as a coach).

Definitely a fair question and we never know how we'll react in such a situation til we are in one, but I certainly like to think I'd have not just let it slide after reporting it to my boss, especially when I kept seeing the guy with young boys.

and WADR, I don't think most of you would have gone to the police in Joe Pas shoes. I think most of you would like to believe you would (and have convinced yourselves of it), but when push comes to shove, I just don't think most of you would. I'm not sure if I would have or not; I would be feeling incredibly guilty if I were Joe Pa right now.

I think a lot of this is misdirected anger, and a lack of empathy and pragmatism (IMO only of course)

joe pa should be feeling extremely guilty right now. for someone that claims to be a great teacher and mentor and someone that states that he is totally committed to psu and its students he completely failed. I'll give him a pass on "following the rules" and only reporting this to his supervisors at first, but seeing this dirtbag continue to drag kids around campus and road games over the years is inexcusable. paterno is guilty of being a human with a terrible moral code and should feel guilt for his non actions for the rest of his life

If Joepa would have done more, followup with the call, alert the authorities, or something along those lines it may have saved some other victims the same abuse victim 1 had. What's the downside there? How can you hear your assistant coach was in the shower with a ten year old boy having sex, make one phone call, and dismiss it?

yeah, I was very surprised when all these national articles were/are saying there was no legal duty to report. FWIW our local news casted doubt on that assertion, but I haven't seen any other article do the same (not to say other articles haven't, I just haven't seen them...everything I've read notes that he had no legal duty to report, including articles calling for his firing/resignation)

Personally, I thought school officials, including coaches, were mandated reporters everywhere.

In Minnesota, and probably many other states if not every other state, in HS and below, anybody who is employed by the school system (private or public) is a mandated reporter...teachers, aides, school nurses and social workers, custodians, etc.

as far as joepa goes, we are also operating under the assumption that he wasn't involved in any coverup. it is possible he knew more than is being let on. like i said in my post...when the details start coming out things usually get worse, not better. Part of his obligation as a coach, and basically the ambassador for PSU, is (in few words) to basically not make the university look stupid. By not doing anything above what he did do, he failed there. Along with McQueary, the AD, the president, the janitor, etc.

it's funny how much we agree, and how much of that agreement is the basis for our disagreement. I agree with the above 100%, which is in part why I give him a bit of a pass on not going to the police right away (of course, this only creates a little wiggle room because he had no legal duty to report to the police, and because he did have a duty to report it to the AD, which he promptly did...everything other than that turns on the ethical/humane duty, which is not so cut and dry in my mind based on pragmatic considerations, specifically putting myself in Joe Pa's shoes and realizing what a fucking horrible mess and lose/lose situation to be placed in
