Summit II Talk

I guess we need to get a little more organized for the summit. If you've made your flight reservations, send me the dates and times. You can email, text, or send me a message on Facebook and I'll put something together. I'm going to start asking around about some good bars and restaurants up there as some family and friends went to UT and they'll know a lot more than I do. Any requests of what you want to see when you're in town?

We will be within walking distance of 6th street. I plan on renting a larger SUV...but was thinking we should so 6th street at night. I'll DD during the day. H said he would DD at night...s.

H is flying into Houston on that Friday and will be riding up with me...ETA will be around 2:30 at the hotel bar.

No "here for this" this weekend. I have a lot of nothing going on this weekend aside from attending a small wedding on Saturday. Work next weekend and Port Aransas beach trip the following weekend...suite!

Casey Anthony talk...I have a hard time believing that the justice system failed, I see it more as the prosecution failing. I think its horrible that that little girl was murdered and her mom at the very least had something to do with it. I do believe that a jury can't convict on the premisis of "She had to have done it!"...which is what the majority of the public is basing their opinion on. I believe the same thing too...just think the prosecution failed and not the justice system.

Work is planning a weekend boondoggle of sorts down in Galveston, TX for three days at the end of August. It is a weekend thing, but its paid with per diem and lodging as well. Should be suite...haven't done anything like that here in over ten years.

That's all I have...go.

it would depend. the income statements really can be showing a net loss because of a lot of non-cash items like depreciation of the building, interest on any debt, and amortization of the initial investment cost. A better thing to look at would be their statement of cash flows which would show if they're truly losing money because it strips away all those non-cash items that you get to deduct for tax purposes.

I would guess that they're including the debt service and depreciation expense on the buildings as part of their "losses", even though those aren't really operating expenses.


but the amount of money they say they need to recoup in salaries makes me think they really are losing cash

say the avg ticket is $75 and avg attendance was $17K which is the actual average.

That means that each team only brings in $52m in revenue from the gate. Salary cap was $70m or something like that.

Excluding TV money and all the other expense, this is a lose situation

it's not too difficult to see how the economics are screwed up.


The other option the teams have is raising ticket prices by 30%, and that's probably not going to happen

I don't know how these guys would know this unless they looked at their books, which they didn't. They're making an assumption probably based on what they may have been told.

I could be wrong, but I didn't think gate receipts accounted for the majority of revenue for owners ....I thought that came from merchandising, licensing, tv/radio contracts, etc.

NBA recieves 930m/year for TV rights, not including the local broadcasts

so that's 31m per team if the "league" doesn't take a cut off the top.

not sure what that brings in.

of course there's all the concession and other crap too.

but i'm sure rent/mortgage payments on those buildings isn't cheap

also have to figure in the fact that salary cap is only players salaries, then there's the coach and all the front office personnel and the back office people.

Reasonable doubt is too broad of a term. The defense brings up "she was molested when she was a kid". They don't prove it, but it gives some of the jurors a reason to doubt

but I don't think there's a way to narrow it. The only burden of proof that really means the same thing to everybody is the standard civil burden of proof: preponderance of the evidence (because it means 50%....simple: who do you believe more?).

-the other standards ("clear and convincing" "beyond reasonable doubt", etc.) are so cloudy, we can't even estimate an overall percentage of certainty because it varies from person to person (is reasonable doubt 99% sure? 95%? Is clear and convincing 75% sure? Depends on the person)

-Maybe we should just switch to percentages of certainty, since at least then everybody would go in with the same objective burden. So, instead of beyond a reasonable doubt, maybe it should be, beyond 95% certainty of guilt.

*Not saying it's a good option, just the only option if I can see that would make the burden less subjective
