Dude, where's my seat?!?!

So the whole Super BowlTM seat fiasco thing has been well documented and now there is a class action lawsuit filed on behalf of all these people. I'll give my opinion. I think it really sucks that those 400 people didn't have a seat for them when they got in the stadium. That's something you can't change, however I think the NFL has done a good job in trying to right a situation that can't ever be fully fixed.

I understand that some of these fans were either Steeler or Packer fans coming down to see their team. They didn't have a seat and that really sucks. They did get to watch the game on a TV, got free food and merchandise, and were allowed on the field after the game. I bet that was more than awesome for the Packer fans that were displaced.

After that the NFL offered them two options. Option 1 was $2400, and airfare, hotel, and tickets to next years Super BowlTM; Option 2 is airfare, tickets, and hotel to another Super BowlTM of their choice in which they can decide after the conference championship games in case their team makes it again. So with either of those options these fans are pretty much getting 2 Super BowlsTM for the price of 1.

While I think what happened to those fans really sucked, I believe the NFL has been fair with what they are offering and I don't think they deserve anything else from a class action lawsuit. One of the things the lawsuit is claiming is deceptive sales practices. I don't think they'll be able to prove that. I think these seats would have been ready had it not been for the record setting bad weather the Dallas area had the week before the game. There is no deception there, just bad circumstance. I do think there is an element of greed here, either with Jerry Jones or the NFL, in trying to break the record for Super BowlTM attendance.

I also think class action lawsuits are usually just ways for lawyers to get a big payday while the remaining money is spread around to a lot of people and they don't see much. Kod can speak more on that...maybe i'm wrong. And punitive damages? Stop it. Yeah...I hope they don't get a dime from the lawsuit.

I've known a few lawyers (shocking I know) who do class action lawsuits and after a few drinks they'll readily admit this. It's all about the millions in fees they can get from such a suit, although I think in this case it's also about the publicity.

-I agree with that to some extent. Class actions are necessary a lot of times when a large group of people get screwed over for a pretty paltry sum (like $500 or less). They serve 3 important purposes

1) Helping people secure legal assistance.
-There are very few attorneys (outside legal aid programs) who will take cases for only a few thousands of dollars or less.
-Unless you can get a free one, it wouldn't make sense to pay attorney fees larger than what you are seeking to collect.
-Class actions are generally "the little guy" against big companies or sometimes even government entities. These organizations generally have huuuge resources and very experienced and high ranking attorneys; for them, going up against a pro se party is like a wolf fighting a chicken.

2) Conserving limited judicial resources
-Courts are broke; waiting lists for getting a hearing are insane (at least 6 months for most things in Minni, and that's relatively short compared to the rest of the Country these days)
-With class actions, instead of thousands or tens of thousands of small claims court actions taking up precious judicial resources, you get one big class action.
***I cannot emphasize how important class actions are for this reason alone. If they were outlawed, a huge infusion of cash would be necessary to keep Courts somewhat operational.

3) Convenient forums
-Many times, even unkowingly, when you purchase a product or service you sign an agreement on choice of venue...which odds are is not going to be in your home state. I wouldn't sue Best Buy for $1000 if I had to travel to California to file my claim (Courts generally hold up these choice of forum venues). With class actions, unless you are a principle plaintiff, you don't have to go to Court, attend depositions, meet with your attorney, etc.
-Without class actions, on average I would estimate 90-98% of the class would not otherwise get any relief.



*That being said, the class action set up is far from perfect, and attorneys make waaaaaayyyy to much money in most of these settlements. Take the Cobell settlement that just got approved; they are arguing over whether the attorneys should get 100 million, or 250 million...whatever they get is going to decrease the award of each class member. I'm sure the attorneys did great, but there is no way you can justify those kind of attorney fees IMO.

Punitive damages also play a critical role in our justice system...but I don't think they should be awarded here.

troof, but by getting more back at tax time (with more withheld) you lose the time value of your money. Personally I claim 2 and roll the extra into my Vanguard account (since of course the IRS doesn't give you any interest when you claim 0).
Depending on your situation, claiming 0 can be good. Sdkod2 does that because they are low income, and they like getting 10K plus back in one lump some at the beginning of the year instead of just a little more each paycheck throughout the year; they also don't invest, so they wouldn't get really any interest anyway from their checking account.

From what I know about mileage that I've done on my taxes, you basically can only write off the mileage above and beyond the actual distance you drive to and from work. So i basically say that my office is 15 miles from my house, so I can only deduct any miles over 30 that i drive ach day. And you should keep a log of your mileage just in case

I was drinking about 5-6 20oz bottles of soda a day. Now I drink 1 maybe 2 a month if that. I have cut way down. Drinking a lot more water and tea.

I know this is the case with regular employment. I think or at least I am being told that the rules governing milage are different when deal with nonemployee compensation, i.e. independent contractor. I dunno. I'm gonna go to a professional anyways.
